Terms of Service
Last updated: October 3, 2026
These Terms of Service govern access to cloudxm.com.br and use of services, products, and applications offered by CLOUDXM TECNOLOGIA LTDA. By accessing or using them, you confirm that you have read and accept these Terms. Contracted services may also be subject to a proposal, agreement, or specific commercial terms; where they conflict, the service-specific instrument controls for the contracted service.
1. Provider
CLOUDXM TECNOLOGIA LTDA., Brazilian taxpayer ID (CNPJ) 53.245.805/0001-61, Rua Apiacás, 621, apartment 71, Perdizes, São Paulo/SP, Brazil. Contact: contato@cloudxm.com.br.
2. Services
CloudXM offers services and solutions for digital operations, including e-commerce strategy and operations, integrations, automation, website and landing-page creation, marketing and performance analysis, managed WooCommerce stores, and CloudXM digital products. Availability, scope, pricing, support levels, and conditions for each engagement are set out in the applicable proposal or agreement. Website information is descriptive and does not by itself constitute a binding offer or guarantee of a specific commercial result.
3. Accounts, authorization, and Meta integrations
You must provide accurate information, keep your accounts secure, and have authority to accept these Terms and connect business accounts. When authorizing a Meta integration, you instruct CloudXM to access and process only data made available through granted permissions and necessary for the requested function. You may revoke authorization in the relevant platform settings. Use of Meta remains subject to Meta’s own terms, policies, and requirements, which are independent of these Terms. CloudXM does not control Meta’s availability or decisions.
4. Permitted use and user responsibilities
You agree to use the services lawfully and with proper authorization; respect third-party rights and rules of connected platforms; maintain the permissions and legal grounds required for information you provide; review the accuracy of data and instructions; and not attempt unauthorized access, interfere with security, introduce malicious code, or use the services for fraud, spam, or rights violations. You are responsible for your account, users, and submitted content.
5. Personal data and confidentiality
CloudXM’s personal data processing is described in the Privacy Policy at /en/privacy-policy/. When CloudXM processes personal data on behalf of a business customer, instructions, responsibilities, and additional safeguards may be set out in a data processing agreement. The customer is responsible for having a lawful basis and providing appropriate notices to individuals whose data it makes available. Each party must protect the other party’s confidential information and use it only for the purposes of the relationship.
6. Intellectual property
The CloudXM brand, website, materials, software, interfaces, and original content are protected by intellectual property rights. These Terms grant only a limited, non-exclusive, revocable, non-transferable license to access the services as contracted. Customer data, brands, and materials remain the property of their respective owners. Third-party components remain subject to their own licenses and terms.
7. Third parties and availability
Services may depend on hosting, telecommunications, payment, commerce, or platform providers such as Meta, Google, Shopify, and others. These third-party services have their own terms and may experience interruptions, changes, or limitations outside CloudXM’s control. CloudXM will use reasonable efforts to keep its services available but does not guarantee uninterrupted operation unless a specific agreement provides a service level.
8. Pricing, payment, and cancellation
Prices, billing periods, payment methods, taxes, renewal, notice periods, and cancellation terms are those stated in the service proposal or agreement. Without a specific engagement, merely browsing this website does not create a paid subscription. Overdue amounts and obligations that by their nature continue after termination remain due.
9. Suspension and termination
CloudXM may suspend or terminate access when necessary to comply with law, protect security, respond to a breach of these Terms, or comply with a connected platform’s direction. Where practical, we will notify you and allow the breach to be corrected. You may stop using the services and request termination of a contracted service according to its agreement.
10. Warranties and liability
To the extent permitted by law, services are provided according to their contracted scope, and CloudXM does not guarantee specific economic, commercial, or audience results. CloudXM is not responsible for outages or acts of third parties outside its control, or for damages caused by unauthorized use, inaccurate instructions, or the user’s breach of these Terms. Nothing in these Terms excludes liability that cannot be limited by law, including consumer rights where applicable. Additional liability limits may be stated in a specific agreement.
11. Changes to these Terms
We may update these Terms to reflect changes to our services or applicable law. The current version and its update date will be posted on this page. Material changes affecting a contracted service may be communicated through available contact channels. Continued use after the new version takes effect constitutes acceptance, subject to rights and procedures provided by law or contract.
12. Governing law and venue
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of São Paulo/SP shall have jurisdiction, without prejudice to any venue legally available to a consumer. If any provision is held invalid, the remaining provisions remain effective to the fullest extent permitted.
